Rule 93
Impaired instincts

(1) If an employee is physically or mentally disabled for government service due to an accident or injury in the course of government work, as long as such employee survives for his own livelihood, he shall receive the pension as written in sub-rule (2) along with the pension as written in sub-rule (3). Will get disability allowance.
(2) According to sub-rule (1), if the service period of an employee who is disabled has reached the point of receiving pension, the amount that will be calculated from the salary in accordance with section 48 of the Act, if he/she has received immediate compensation (including if he/she has worked on a permanent basis or has worked as an agent in accordance with rule 43) Will get equal disability pension. If the service period of such a disabled employee has not reached the point of receiving pension, the remaining amount will be deducted from Damasahi for every full or half year before reaching the year of receiving pension according to the law. While deducting in this way, more than one third of the amount will not be deducted.
(3) According to sub-rule (1), an amount of up to twenty-five thousand rupees can be given as financial assistance to an employee who is disabled according to the condition of the injury. In the event that financial assistance is not given in this way, he will receive disability pension according to sub-rule (2) in terms of the final scale of the highest post he currently holds (permanently held or if he has acted as an agent in accordance with rule 43).
(4) In accordance with sub-rule (1), the concerned employee will receive 100% of the treatment expenses incurred in case of injury. Due to the receipt of such treatment expenses, it shall not be considered that any obstacle has been created for such employee to receive the treatment expenses which may be received as per sub-rule (1) of rule 91 when he becomes ill.
(5) In addition to the disability pension received by the employee due to disability in accordance with sub-rule (2), the amount of monthly disability allowance that the employee will receive will be equal to 20% of the salary received by him. Explanation: If an employee who has received or is determined to receive a disability status is re-entered into any service later, he will not receive the disability status written in this rule. However, if the disability allowance or additional financial assistance amount is paid, fThere is no need to do it.
(6) If the death of an employee who has been or is receiving disability benefits is within seven years from the date of starting to receive disability benefits, a lump sum amount will be given to the family members of such employees as deemed appropriate by the Government of Nepal. > (7) If an employee is disabled due to injury or willful negligence, he/she will not be entitled to the benefits under this rule.
